This Privacy Policy explains how ContentGen®, including ContentSaaS-AI (collectively, "ContentGen®," "we," or "us") collects, uses, and discloses information about you. This Privacy Policy (the "Policy") applies to information we collect when you use our website at www.contentgen.com, along with any other affiliated websites we own or operate (individually and collectively, the "Website"), mobile applications, and other online products and services that link to this Policy (collectively, together with the Website, our "Services"), when you contact us, engage with us on social media, and otherwise interact with us. This Policy does not apply to information collected by any third party, including through any application or content that may link to or be accessible from or through our Services. We are not responsible for the privacy practices of any such third parties, and we encourage you to review the privacy policies and practices of any third party before providing your information. This Policy includes the following:

  1. What personally identifiable information we collect, how it is used, and with whom it may be shared.
  2. What choices are available to you regarding the use of your data.
  3. The security procedures in place to protect against the misuse of your information.
  4. How you can correct any inaccuracies in your information.

We reserve the right to update and change this Policy from time to time. 1. Information Collection
When you visit our Website

You are free to explore certain portions of the Website without providing any Personal Information about yourself, but even if you elect not to provide us with any Personal Information, we may collect Navigational Information and other information from third parties described below.

Personal Information

"Personal Information" we collect on or through our Services is defined as any information by which you may be personally identified, such as your name, company name, address, email address, telephone number, and other similar information. Personal Information may include:

  • Information that you provide to us, including by filling in forms, on our Website or other ContentGen® platforms.
  • Records and copies of your correspondence (including email addresses) if you contact us.
  • Your responses to surveys that we might ask you to complete for research purposes.
  • Details of transactions you carry out through our Website and of the fulfillment of your orders.
  • Information we receive when you subscribe to communications from us.
Navigational Information

Navigational Information refers to information about your computer and your visits to the Website such as your IP address, geographical location, browser type, referral source, length of visit, operating system, and pages viewed.

Navigational Information may include Personal Information, or we may maintain it or associate it with Personal Information we collect in other ways or receive from third parties. It helps us to improve our Website and to deliver a better and more personalized service, including by enabling us to:

  • Estimate our audience size and usage patterns.

We currently only use cookies and tracking technologies that are necessary for our Website to function, such as strictly necessary cookies, pixel tags, local storage, and session storage. These technologies cannot currently be individually accepted or declined; if you do not wish to have these technologies placed on your device, your option is to discontinue use of our Website. To request deletion of Personal Information previously collected through cookies or tracking technologies, please contact us using the information in the Contact Information section below.

Information we collect from third parties

From time to time, we may receive Personal Information about you from third-party sources, including partners with which we offer co-branded services or engage in joint marketing activities, and sources such as social media websites.

Information about children

The Services are not intended for or targeted at individuals under 18 years old, and we do not knowingly or intentionally collect Personal Information about or from individuals under 18 years old. If you believe that we have collected Personal Information about or from an individual under 18 years old, please contact us here, so that we may delete the information.

2. Information Use, and Sharing
Compliance with our Privacy Policy

We use the information we collect only in compliance with this Policy, as it may be updated from time to time at our discretion. We do not sell or rent Personal Information to any third party, but we may grant other parties access to information we collect from time to time in accordance with this Policy.

Third Party Data Processors

ContentGen® works with third-party vendors ("Service Providers") that process certain customer data on our behalf. If required by law, a Service Provider's bona-fide internal policy, or as we may otherwise elect, we enter into written agreements with each Service Provider that restrict their use of Personal Information to the purposes for which it was disclosed and require them to maintain appropriate security measures consistent with this Policy. As of the Last Revised date of this Policy, our Service Providers include Clerk (identity and authentication management) and Stripe (payment processing). We may engage additional or replacement Service Providers from time to time. ContentGen® remains responsible for the Personal Information we share with our Service Providers. Certain Service Providers may process Personal Information in jurisdictions outside your country of residence, and by using our Services you acknowledge that your Personal Information may be transferred internationally subject to applicable data protection safeguards. If you have questions about how a Service Provider handles your Personal Information, you may contact us or refer to the applicable Service Provider's privacy policy.

Use of Personal Information

In addition to the uses identified elsewhere in this Privacy Policy, we may use your Personal Information to:

  • Improve your browsing experience by personalizing the Website;
  • Develop and improve our products and services;
  • Develop and improve new products and services, including automated tools and large language models that may be incorporated into our products and services in the future;
  • Send information or content to you that we think may be of interest to you by post, email, or other means and send you marketing communications relating to our business;
  • Respond to you regarding the reason you contacted us;
  • Provide other companies with statistical information about our users (but this information will not be used to identify any individual user and will only be shared on an aggregate and de-identified basis);
  • Contact you about billing, account management, and other administrative matters;
  • Send information to you regarding changes to this Policy or other legal agreements;
  • Fulfill the purposes for which you provided the information; or
  • Meet legal requirements.

We do not currently share your Personal Information with any third party outside of our organization, other than as authorized by you or as necessary to fulfill your request (such as with Claude or another third-party large language model service provider). [We do not use Personal Information submitted through our Services to train, improve, or develop any machine learning or artificial intelligence models.] However, we retain the right to share this information at our discretion to the extent it becomes necessary or helps further our business goals, provided, however, we will seek to limit the amount of Personal Information shared as much as reasonably possible.

Any such Personal Information used to generate content, or any other Personal Information we share with third parties in accordance with this Policy, will be subject to the applicable third party's privacy policy and other similar related policies. We avoid sharing Personal Information with third parties that use such information to train AI models. As of the date of this Policy, the large language model service provider we use, Claude, does not use any such information to train its AI models according to its Commercial Terms of Service and Data Processing Addendum. If you are concerned about your Personal Information being shared with Claude in accordance with this Policy, please contact us using the contact information below to let us know.

If you have questions on the privacy policy or data practices of any third party that we share your Personal Information with at your request or in accordance with this Policy, please refer directly to the privacy policy of such party.

Use of Navigational Information

We use Navigational Information to operate and improve the Services and to provide you with a better experience. We may also use Navigational Information alone or in combination with Personal Information to provide you with personalized information about our services. Navigational Information, such as an IP address, is used to approximate your location. For example, we may use your approximate location to provide content that has been translated or send emails at certain times using your local time zone.

You may disable the collection and use of your location data through browser-operating system or device-level settings.

Your access to and control over Personal Information

You may opt out of any future contacts from us at any time. You can do the following at any time by contacting us via the email address or phone number given on our Website:

  • See what Personal Information we have about you, if any.
  • Change/correct any data we have about you.
  • Have us delete your account, which will delete the Personal Information we have about you (excluding any de-identified data that is used or shared in the aggregate with other data). Because we only collect the Personal Information necessary for our Services to function, deleting this information means deleting your account; if you would prefer that we not hold this information, your option is to discontinue use of our Services.
  • Express any concern you have about our use of your Personal Information.

California and European Union residents may have additional rights and choices related to their personal information, which are set forth below.

Security

We take precautions to protect your information. When you submit Personal Information via the Services, we take reasonable measures to protect that information consistent with industry standards.

While we use encryption to protect sensitive information transmitted online, we also take reasonable measures to protect your information from unauthorized access or use offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to Personal Information. The computers/servers in which we store personally identifiable information are kept in a secure environment.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we take reasonable precautions to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted via the Services. Any transmission of Personal Information is at your own risk, subject to any limitations under applicable law. We are not responsible for any circumvention of any privacy settings or security measures contained on the Services.

Data Retention

We retain Personal Information only for as long as reasonably necessary to:

  • Provide or support our Services.
  • Meet legal, operational, or contractual obligations.
  • Satisfy the purposes for which the information was collected.

When no longer needed, information is securely deleted or de-identified. Retention schedules may vary by data category.

California Privacy Rights

This section applies only to California residents. It describes how we collect, use, and share California consumers' Personal Information in our role as a business, and the rights applicable to such residents. The California Consumer Privacy Act ("CCPA") requires businesses to disclose whether they sell Personal Information. We do not sell Personal Information. We may share Personal Information with third parties in accordance with this Policy if those third parties are authorized service providers or business partners that have agreed to our contractual limitations as to their retention, use, and disclosure of such Personal Information.

This applies only to California residents. For non-California residents, if there are any discrepancies between this Section and the remainder of the Policy, the remainder of the Policy controls except as provided under applicable law. For California residents, if there are any discrepancies between this Section and the remainder of the Policy, then this Section controls.

For purposes of this Section, "Personal Information" has the meaning given in the CCPA.

How we collect, use, and share your Personal Information

We have collected the following statutory categories of Personal Information in the past twelve (12) months:

  • Identifiers, such as name, email address, mailing address, and phone number. We collect this information directly from you or from third-party sources.
  • Commercial information, such as subscription records. We collect this information directly from you.
  • Internet or network information, such as browsing and search history. We collect this information directly from your device.
  • Geolocation data, such as IP address. We collect this information from your device.
  • Other Personal Information, in instances when you interact with us online, by phone, or mail in the context of receiving help with our product or services.
Your California rights

You have certain rights regarding the Personal Information we collect or maintain about you. Please note these rights are not absolute, and there may be cases when we decline your request as permitted by law.

The right of access means that you have the right to request that we disclose what Personal Information we have collected, used, and disclosed about you in the past 12 months.

The right of deletion means that you have the right to request that we delete Personal Information collected or maintained by us, subject to certain exceptions. Because we only collect the Personal Information necessary for our Services to function, fulfilling a deletion request means deleting your account.

The right to non-discrimination means that you will not receive any discriminatory treatment when you exercise one of your privacy rights.

Your GDPR rights

Users located in the European Economic Area ("EEA") have additional rights under the General Data Protection Regulation ("GDPR"). Where we process your Personal Information, we rely on your consent as the lawful basis for such processing under the GDPR.

  • Right to Access – you may request copies of your personal data.
  • Right to Rectification – You may request correction of inaccurate data.
  • Right to Erasure ("Right to be Forgotten") – You may request deletion of your data. Because we only collect the Personal Information necessary for our Services to function, fulfilling this request means deleting your account.
  • Right to Restrict Processing – You may request temporary suspension of processing.
  • Right to Data portability – You may request your data in a transferable format.
  • Right to Object – You may object to processing based on legitimate interests or direct marketing.
  • Right to Withdraw Consent – You may revoke consent at any time.
How to exercise your rights

You can exercise your rights yourself or you can alternatively designate an authorized agent to exercise these rights on your behalf. Please note that to protect your Personal Information, we will verify your identity by a method appropriate to the type of request you are making. We may also request that your authorized agent have written permission from you to make requests on your behalf, and we may also need to verify your authorized agent's identity to protect your Personal Information. EEA residents may also lodge a complaint with their local Data Protection Authority.

Note, the right to erasure may not extend to personal data held by third-party processors subject to mandatory legal retention obligations under applicable law or bona-fide internal policy.
